1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Vento Digitale di Marco Forlani ("we", "us", "our", or "Company"), a business entity operating in Italy and subject to European Union laws and regulations, governing your use of the TotalAnalyzer service (the "Service").

By creating an account, uploading content, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

TotalAnalyzer AutoContent (accessible at keyon.totalanalyzer.ai, referred to in these Terms as the "Service") is a Software-as-a-Service (SaaS) platform that generates SEO-optimised textual content — primarily blog articles — starting from a description of your business, product, or service. The Service enables users to:

Content generation is fully automated and typically runs through the following main steps:

  1. Business analysis — we process your written business description, or automatically crawl the main pages of the website URL you provide, to understand your activity, positioning and target audience
  2. Keyword extraction and expansion — our AI extracts the most significant keywords and expands them into a broader set of relevant terms for each selected language
  3. Search-volume enrichment — for paid projects, real monthly search-volume data is retrieved from professional SEO data providers for each keyword
  4. Editorial planning — keywords are organised into topic clusters and an editorial plan is generated, selecting the best keyword for each article
  5. Article generation — each article is written natively in its target language and delivered in HTML, Markdown, plain text and JSON-LD formats

2.2 Projects and Credit Consumption

Content-generation activity is organised into projects. For each paid project you choose the target number of articles and one or more target languages. Unless expressly indicated otherwise at the time of project creation, a paid project has a fixed credit cost regardless of the number of articles selected, so larger article counts deliver a better cost-per-article. The exact credit cost of a project, and the options available for it (number of articles, supported languages, advanced features), are displayed within the Service at the time of project creation and are the ones that apply to that specific project.

2.3 Free Tier and Feature Limitations

The Service offers a free experience that allows eligible users to test the pipeline without purchasing credits. The free tier is intentionally limited in terms of number of free projects or articles, search-volume data sources, and any other feature explicitly marked as restricted within the Service. During the free tier, keyword search volumes may be AI-estimated rather than fetched from third-party providers. The exact free-tier allowance at any given time is shown in your account dashboard; we may modify, reduce, or discontinue the free tier at any time without prior notice.

3.1 Age Requirements and Eligibility

To use TotalAnalyzer, you must be at least 13 years of age. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

3.4 Multiple Accounts and Anti-Abuse

We implement automated systems to detect and prevent abuse, including but not limited to IP address monitoring and browser fingerprinting. Creating multiple accounts to circumvent Service limitations or to obtain unauthorised free projects, articles, or credits is strictly prohibited and may result in immediate termination of all associated accounts without refund.

4. User Obligations and Prohibited Conduct

4.1 Ownership and Authorization

CRITICAL REQUIREMENT: You represent and warrant that you are the sole owner or have obtained all necessary rights, licenses, consents, and permissions to use and submit any content to our Service, including but not limited to business descriptions, website URLs and the pages they point to, brand materials, trademarks, logos, existing keywords, and any other intellectual property.

5. Free Tier and Usage Limitations

5.1 Free-Tier Access

The Service includes a free tier that allows eligible users to generate a limited amount of content without purchasing credits. The exact allowance — for example the number of free projects, the number of free articles per project, and whether real search-volume data is included — is displayed in your account dashboard and is the one applicable at the time of project creation.

5.2 Feature Limitations

The free tier is provided with reduced functionality compared to paid projects. In particular, free-tier keyword volumes may be AI-estimated rather than fetched from third-party professional providers, and certain advanced features, output formats, or language options may be restricted or disabled.

5.3 Anti-Abuse and Changes

Free-tier allowances are personal, tied to your account, and cannot be resold, traded, or transferred. Unused allowances do not accumulate beyond their defined validity period, if any. We reserve the right to modify, reduce, or discontinue the free tier at any time, with or without notice.

6. Purchased Credits and Payment Terms

6.1 Credit Purchase

Users may purchase credits to run full paid projects, which unlock the complete pipeline described in Section 2.1 — including real search-volume data, the full set of output formats (HTML, Markdown, plain text, JSON-LD), and any advanced features not available on the free tier.

6.2 Payment Processing

All payments are processed through Paddle, a third-party payment processor. Paddle independently manages all aspects of payment processing, including but not limited to:

By making a purchase, you agree to Paddle's terms of service and privacy policy. We do not store or have access to your complete payment card details.

6.3 Credit Validity Period

Purchased credits are valid for twenty-four (24) months from the date of purchase. We will provide at least five (5) days advance notice before expiring credits. After expiration, unused credits will be removed from your account without refund.

6.4 Credit Transferability

Credits are non-transferable between user accounts and are permanently associated with the account through which they were purchased.

6.5 Bonus and Promotional Credits

Credits obtained through promotions, referral programs, bonuses, coupon codes, or other free allocations are subject to the same usage terms but may have different expiration policies as specified at the time of grant. We are not obligated to provide refunds for credits obtained free of charge.

All prices are exclusive of applicable VAT or other taxes, which are calculated and added at checkout based on your billing country by our payment processor (Paddle). Prices may be updated at any time; the price displayed at checkout is the price you pay. The Agency price is automatically applied when you have an active Agency Subscription (see Section 6A).

6A. Agency Monthly Subscription

In addition to one-time credit packages, we offer an optional Agency Subscription aimed at users who operate on behalf of multiple clients or manage content for several projects.

6A.3 Automatic Renewal

The Agency Subscription renews automatically at the end of each monthly billing cycle at the then-current price, unless you cancel before the renewal date. By subscribing, you expressly authorize us (through Paddle) to charge your payment method on each renewal for as long as the subscription remains active.

6A.4 Right of Withdrawal (EU Consumers)

If you are an EU consumer, you are entitled to a 14-day right of withdrawal from the initial subscription purchase under EU Directive 2011/83/EU. However, by subscribing you expressly consent to the immediate provision of the digital service and acknowledge that you will lose the right of withdrawal as soon as you start using any paid feature of the Agency plan (for example: creating or editing a client, assigning a project to a client, or purchasing a discounted credit pack).

Renewal charges after the initial period are not subject to a new withdrawal period and can only be prevented by cancelling the subscription before the next renewal date.

6A.5 Cancellation

You may cancel the Agency Subscription at any time, with no penalty:

Cancellation stops future automatic renewals. The subscription remains active until the end of the current billing period already paid for. No pro-rata refund is issued for the remaining days of an already paid period.

6A.6 Effect of Cancellation or Lapse

When your Agency Subscription lapses or is cancelled:

A lapsed Agency Subscription can be reactivated at any time from the subscription page. Reactivation restores full Agency functionality, including the credit pack discount, starting from the next successful payment.

6A.8 Irreversibility of Agency Status

Once your account has been upgraded to Agency status upon the first successful subscription payment, this status is permanent and cannot be reverted. If you later cancel the subscription, your account will be treated as "Agency with inactive subscription" — with the behavior described in Section 6A.6 — but it cannot be converted back to a standard (non-Agency) account. This is a one-way upgrade due to the additional data structures (clients, project-client associations) created for Agency accounts.

6A.9 Price Changes

We reserve the right to change the Agency Subscription price. Any price change applicable to your subscription will be communicated to you at least 30 days in advance via email or in-app notification. If you do not agree with a price change, you may cancel the subscription before the new price takes effect. Continued use of the subscription after the effective date of the new price constitutes acceptance of the new price.

6A.10 Failed Payments

If an automatic renewal payment fails, we (via Paddle) may retry the charge within a reasonable period. If payment cannot be collected, the subscription will lapse and the effects described in Section 6A.6 will apply. You can restore the subscription at any time by updating your payment method and completing a successful payment.

6A.11 No Refund on Subscription Fees

Subscription fees already paid for the current or past billing cycles are non-refundable, except where required by applicable mandatory consumer law or where a valid right of withdrawal (Section 6A.4) has been exercised within the permitted conditions.

7. Generated Content and Storage

7.1 Availability of Generated Content

All completed projects, and the keywords, editorial plans and articles generated within them, remain accessible in your account 24 hours a day, 7 days a week, for as long as your account remains active, subject to these Terms and our right to terminate accounts as specified herein.

7.2 Output Formats and Export

Each generated article is made available inside the project dashboard in the following formats:

You may copy or export these formats directly from the project dashboard. We do not commit to providing PDF or any other export format beyond those listed above, and the visual presentation of an article may differ across formats and compared to the in-dashboard preview.

7.3 Input Retention and Deletion

We retain the inputs and outputs of the Service as follows:

We do not maintain public archives of your inputs or outputs, we do not transfer your inputs to external consumer cloud storage, and we do not use your business-specific inputs to train third-party or our own AI models beyond what is strictly necessary to deliver the Service to you.

8. No Refund Policy

8.1 Right of Withdrawal (EU Consumer Rights)

This Section 8 applies to one-time credit package purchases. Withdrawal, cancellation and refund terms applicable to the Agency Monthly Subscription are set out in Section 6A (in particular Sections 6A.4, 6A.5 and 6A.11) and prevail over this Section 8 for the subscription product.

In accordance with EU Directive 2011/83/EU on consumer rights, you have the right to withdraw from the purchase within 14 days without providing any reason.

EXCEPTION: The right of withdrawal expires immediately when:

IMPORTANT: Decisions regarding how to use, edit, publish, distribute, or monetise the generated content — including on your own website, your clients' websites, or any other platform — remain entirely your own responsibility. We are not liable for any actions you take or do not take based on our generated content.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR:
